1.1 ENFORCEMENT OF CONDITIONS
These terms of trade shall apply to all invoices issued by Scott Hughes trading as Essential Audio unless amended in writing by Scott Hughes of Essential Audio. All references to Essential Audio hereon are representative of Scott Anthony Hughes trading as Essential Audio. By accepting delivery pursuant to any purchase order placed on Essential Audio, the buyer accepts the terms and conditions contained herein.
1.2 PAYMENT TERMS
Essential Audio currently accepts payment via Direct Deposit, Credit Card, Paypal, Money Order & Cheque. Payment must be completed in full and confirmation of funds received before goods will be dispatched. Surcharges apply to some payment options, Click here to view the list of surcharges.
1.3 PRICING
Prices displayed on this website are for purchases made directly from Essential Audio and all prices include GST. Prices quoted in writing by Essential Audio will be firm for a period of 14 days from the date of offer unless otherwise stated in the written quote. Whilst every effort has been made to list accurate pricing, all prices are subject to alteration at any time without notice.
1.4 TITLE OF GOODS
Title of the goods shall only pass to the buyer following full payment of the relevant Essential Audio invoice. Essential Audio retains ownership of same goods and reserves the right to withold these goods from the buyer if the invoice is not paid within the terms of this contract
1.5 PRODUCT AVAILABILITY
Products appearing on the Essential Audio website may from time to time be unavailable due to unforseen circumstances such as long shipping delays, supplier problems or high demand. Every effort is made to ensure all items listed on the Essential Audio website are available or listed as "out of stock" if not currently available. Essential Audio will notify you if any items on your order are unavailable or will be delayed.
2.0 PRODUCT WARRANTIES OR GUARANTEES
2.1 "The Loudspeaker Kit" Products
2.1.1 "The Loudspeaker Kit" Warranty
All speaker kits supplied to us from "The Loudspeaker Kit" (Waplington Audio) carry a warranty which includes manufacturers defects on all components such as woofers, tweeters and crossover circuits. The warranty does not cover damage to woofers and tweeters caused by overdriving them or powering them from a damaged or distorting amplifier or impact damage. Products submitted for warranty claims must first be assessed by our supplier “The Loudspeaker Kit” and we will abide by their ruling.
2.1.2 "The Loudspeaker Kit" Warranty Periods
M4, S150, S250 & S350 models - 3 year warranty
M5, M6, C5, C6, F5, F6 & TL6 - 7 year warranty
2.1.3 Satisfaction Guarantee
If you purchase a kit from us and are not absolutely satisfied with the sound quality then you can return it to us within 14 days for your money back (this applies to kits only). All you pay is the freight cost back to us provided the components are in as-new condition and you have kept the original packaging. You must return the cabinets as well even if these have been partly or completely assembled.
2.1.4 The Box Build Warranty
We are certain that you will find the cabinets that are supplied with our kits easy to build and of an excellent fit and finish. If, however, you are not absolutely happy with the fit & finish of the MDF panels suppplied in your kit you can return the cabinet to us and we will supply you with a replacement cabinet at a nominal price.
2.2 All products other than "The Loudspeaker Kit" Products
For goods supplied to us from within Australia we will honour the local supplier's guarantee. This is 12 months unless otherwise stated in the product description within the Essential Audio website, eg some Redback equipment carries a 10 year warranty. In the case of a claim of faulty supplied goods they will be requires to be returned by Essential Audio the supplier for verification. Unless otherwise stated the warranty period starts from the date of consignment. All warranties will be immediately void should:
a) The goods be repaired or altered without the technical attention of Essential Audio.
b) Essential Audio reserve the right to waive or amend specific warranty on individual products.
c) The goods have been subject to use outside the stated specifications.
3.0 TRANSPORT & SHIPPING
3.1 Shipping Times
Orders for products that are in stock at the Essential Audio warehouse are generally shipped within 24 hours of receipt of funds. Should a product not be in stock at Essential Audio it will typically be available from the suppliers warehouse. Essential Audio will at all times endeavour to ship products as soon as practically possible with minimal delays. The majority of our customers receive their goods within 2-5 working days. Essential Audio will inform you of any abnormal delays in regards to your order.
3.2 Transport Insurance
Essential Audio recomends all buyers choose registered & insured postage. Responsibility for the goods passes to the buyer once the goods have been passed to the carrier, however, should a problem arise during transport Essential Audio will provide any required assistance within reason. Buyers who elect to use regular shipping or registered shipping without insurance do so at their own risk and Essential Audio will not accept liability should the goods become lost, stolen or damaged during transit.
3.3 Freight on Returns
The buyer accepts liability for all freight costs incurred in the return of goods for the purpose of warranty repair or replacement of faulty goods.
3.4 Damaged Goods
If you have paid for insurance and suspect that the parcel has suffered damage to the point where the goods inside may also be damaged, do not open the parcel. Contact the carrier immediately and deal directly with them to lodge your claim. Essential Audio will provide any required assistance the carrier requires to ensure the issue is rectified as quickly as possible. If you did not choose to insure your order their is no recourse available to recover losses due to transit damage.
4.0 CANCELLATION OF ORDER
Essential Audio will not accept the cancellation of an order after payment has been made unless by prior agreement or due to special circumstances. Order cancellations are subject to compensation costs. Restocking and administration fees may therefore apply. These fees will be determined on a case by case basis.
4.1 REFUNDS
No refund will be given if you simply change your mind or order the wrong product. Essential Audio will provide a refund only in the event of the product being:
a) Faulty
b) significantly different to those shown or described to you
c) not functioning as it is supposed to do so
d) not fit for purpose
4.2 RETURNING GOODS
Goods returned for credit will not be accepted unless prior authorisation has been given by Essential Audio with a return authorisation form or via e-mail. Please call us for details. You must supply the original invoice number and date of purchase. Except for the return of faulty or incorrectly supplied goods, a 20% restocking charge will be applied to all goods returned for credit. Claims will not be recognised unless made within seven (7) days of delivery.
4.3 PROPERTY RIGHTS
Any claim from the sale which may allege infringement of trade marks, trade names, patents, copyrights or property rights of other parties, shall be directed immediately by the buyer to Essential Audio and the buyer will give every assistance to Essential Audio in connection with such claim. The buyer will not itself deal with or compromise any claim, which may occur.
4.4 SPECIFICATIONS
All listed product specifications at the time of publication are as supplied by the relevant products manufacturer. Essential Audio cannot guarantee the accuracy of these specifications. We reserve the right to amend any product specifications or information without prior notice.
4.5 SPECIAL NOTE
Essential Audio and associated entities do not accept any liability whatsoever for any injury, loss or damage sustained by the buyer however arising.
