2.1 ENFORCEMENT OF CONDITIONS
These terms of trade shall apply to all invoices issued by Scott Hughes trading as Essential Audio unless amended in writing by Scott Hughes of Essential Audio. All references to Essential Audio hereon are representative of Scott Hughes trading as Essential Audio. By accepting delivery pursuant to any purchase order placed on Essential Audio, the buyer accepts the terms and conditions contained herein.
3.0 THE LOUDSPEAKER KIT WARRANTY
3.1 Product Warranty
All speaker kits supplied to us from "The Loudspeaker Kit" (LSK Audio) carry a warranty which includes manufacturers defects on all components such as woofers, tweeters and crossover circuits. The warranty does not cover damage to woofers and tweeters caused by overdriving them or powering them from a damaged or distorting amplifier or impact damage. Products submitted for warranty claims must first be assessed by our supplier “The Loudspeaker Kit” and we will abide by their ruling.
M4, D4, S150, S250 & S350 models - 3 year warranty
M5 MKII, M6 MKII, C5 MKII, C6, F5 MKII, F6 MKII, TL6 - 7 year warranty
3.2 Satisfaction Guarantee
If you purchase a kit from us and are not absolutely satisfied with the sound quality then you can return it to us within 14 days for your money back (this applies to kits only). All you pay is the freight cost back to us provided the components are in as-new condition and you have kept the original packaging. You must return the cabinets as well even if these have been partly or completely assembled.
3.3 The Box Build Warranty
We are certain that you will find the cabinets that are supplied with our kits easy to build and of an excellent fit and finish. If, however, you are not absolutely happy with the finish you have obtained, you can return the cabinet to us and we will supply you with a replacement cabinet at a nominal price.
3.4 MANUFACTURERS AND/OR AGENTS GUARANTEES FOR ALL PRODUCTS OTHER THAN LSK PRODUCTS
For goods supplied to us in Australia we will honour the local supplier's guarantee. This is 12 months unless otherwise stated, eg some Redback equipment carries a 10 year warranty. Goods may have to go back to the supplier for verification. Unless otherwise stated the warranty period starts from the date of consignment provided that:
3.4.1 The goods have not been repaired or altered without the technical attention of Essential Audio.
3.4.2 Essential Audio reserves the right to waive or amend specific warranty on individual products.
3.4.3 The goods have not been subject to use outside the extremes of the stated specifications under normal conditions.
3.5 SPECIAL NOTE: Essential Audio and associated entities do not accept any liability whatsoever for any injury, loss or damage sustained by the buyer however arising.
4.0 PAYMENT TERMS
Essential Audio currently accepts payment via Direct Deposit, Credit Card, Paypal, Money Order & Cheque. Payment must be completed in full and confirmation of funds received before goods will be dispatched.
4.1 PRICES
Prices quoted in writing by Essential Audio will be firm for a period of 14 days from date of offer unless otherwise stated in the written quote.
4.2 GST
All listed prices are inclusive of GST.
5.0 Product Availablility
Due to the majority of our suppliers being located within Australia we keep our stock levels to a bare minimum. This enables us to pass on the storage savings to you the consumer and therefore products appearing on this site may from time to time be unavailable should our suppliers run out of stock. Every effort will be made to supply ordered goods within 10 working days, however, unforseen circumstances such as long shipping delays, supplier problems or high demand, can result in long delays before an order can be completed. Essential Audio will notify you if any items on your order are unavailable or will be delayed.
5.1 NEW PRODUCTS: Occasionally, due to reasons beyond our control, new products may be delayed from the time they are posted on the website. Essential Audio will notify you if the product is not yet available, however, we will endeavour to ensure all products listed within the website have been released for sale from our suppliers.
5.2 TITLE OF GOODS
Title of the goods shall only pass to the buyer following full payment of the relevant Essential Audio invoice. Essential Audio retains ownership of same goods and reserves the right to withold these goods from the buyer if the invoice is not paid within the terms of this contract.
5.3 TRANSPORT & SHIPPING
Shipping times will be product and supplier dependant .
LSK Speaker Kits – Allow up to 20 working days from receipt of payment.
All other products – Allow up to 10 working days from receipt of payment.
Essential Audio will endeavour to ship all products as soon as possible with minimal delays. Most customers receive there goods within 5 working days.
5.4 TRANSPORT INSURANCE
Essential Audio recomends all buyers choose registered & insured postage. Responsibility for the goods passes to the buyer once the goods have been passed to the carrier, however, should a problem arise during transport Essential Audio will provide any required assistance within reason. Buyers who elect to use regular shipping or registered shipping without insurance do so at their own risk and Essential Audio will not accept liability should the goods become lost, stolen or damaged.
5.5 FREIGHT ON RETURNS
The buyer accepts liability for all freight costs incurred in the return of warranty repair and replacement of faulty goods without exception.
5.6 DAMAGED GOODS
If you suspect that the parcel has suffered to the point where the goods inside may be damaged, do not open the parcel. Contact the carrier and deal directly with them.
6.0 CANCELLATION OF ORDER
Essential Audio will not accept any cancellation of orders unless by prior agreement and then only upon terms which will compensate Essential Audio for the cost of cancellation. Restocking and administration fees may therefore apply.
6.1 REFUNDS
Essential Audio will provide a refund only in the event of the product being:
i) Faulty
ii) significantly different to those shown or described to you
iii) not functioning as it is supposed to do so
No refund will be given if you simply change your mind or order the wrong product.
6.2 RETURNING GOODS
Goods returned for credit will not be accepted unless:
i) Prior authorisation has been given by Essential Audio with a return authorisation form or via e-mail. Please call us for details. You must supply the original invoice number and date of purchase.
ii) Except for the return of faulty or incorrectly supplied goods, a 20% restocking charge will be applied to all goods returned for credit.
Claims will not be recognised unless made within seven (7) days of delivery.
7.0 PROPERTY RIGHTS
Any claim from the sale which may allege infringement of trade marks, trade names, patents, copyrights or property rights of other parties, shall be directed immediately by the buyer to Essential Audio and the buyer will give every assistance to Essential Audio in connection with such claim. The buyer will not itself deal with or compromise any claim, which may occur.

We reserve the right to amend any product specifications / information without prior notice.
